My husband is a retired Ford/Vestion employee. We were in an auto accident last year, 10/10/2009 in Dallas, TX and sought legal aid. Our case is about to settle. We would like to know if there are limitations on compensation for victims in the State of Texas that don't go to trial? Is Texas a "No Fault State?" The Negotiator told me $12,000 before the Insurance Adjuster even saw any of my documentation. I had $20,000 in lost wages alone and $29,000 in medical bills. This was before she read my personal statement on pain and suffering or considered current loss of wages due to disability. I am still dealing with Post-Concussion Syndrome taking medication for burning brain sensations, sound and motion hypersensitivities. I suffer from memory loss which has impeded my ability to do my regular floor nursing job. Increased mental/physical activity has also increased the burning brain sensations that I experience which have not been controlled by medication at work.
